The RBI Fair Practices Code (2008)

This is the primary regulatory document that governs debt recovery. It explicitly states that "banks should not resort to undue harassment viz. persistently bothering the borrowers at odd hours, use of muscle power for recovery of loans, etc."

  • Right to be Treated with Dignity (Article 21)

    The Supreme Court of India has ruled that the "Right to Life" includes the right to live with dignity. No debt recovery process can violate your fundamental human rights.

  • Protection Against Criminal Intimidation (IPC Sec 503 & 506)

    RBI guidelines strictly forbid calls or home visits before 8 AM or after 7 PM. Any intrusion during "odd hours" is legally actionable.

  • No Forced Property Possession (Securitization Act)

    Even under SARFAESI, banks cannot take physical possession of your property without following the "Due Process of Law," which includes 60-day and 30-day notice periods.

What to do if your rights are violated?

Evidence is key. If you face harassment:

  • Record all calls: Most modern recovery is done via recorded lines; your recordings are valid evidence in court.
  • Save WhatsApp messages: Threats sent over chat are "electronic evidence" under the Indian Evidence Act.
  • Note the Agent's details: Demand their ID and the name of the agency they represent.
